Hi, I'm Kelly and I am a Nurse in Need of Your Help

I am a woman who has dedicated my life to helping others but sadly, I was injured at work and was told by the doctor to stop working. The doctors think that the damage to my knees are extensive but my employer says the injuries are unverified and has convinced the insurance company to hold off treatment. Even though I have been treated terribly by my employer and the insurance company, I still have faith in the caring and compassion of others. It is with this belief that I humbly ask for help. Although financial help is what I need so desparately, even a kind word or some advise will be greatly appreciated.

Dear Kelly: If she can prove your injuries were not work related then she would obviously notify the workmen's comp insurance company and they would not be liable for medical treatment. However, she would have to PROVE it and that is difficult. Since you have the advice of an attorney, why are they not doing their job to secure you the therapy and medical care you need NOW!? As for your pressured fellow workers, did they witness the accident? What are the ramifications for filing false statements on the employers behalf? Sounds like you need shake awake your lawyer. Elaine, Thank you so much for your advice. Comming from suburban Los Angeles to a small, rural town is not only a culture shock, but there are some very intersting dynamics that go on. My employer (also the owner of the company) gathered up several people, who would rather lie than loose their job, to give recorded statements that I didn't get hurt at work. I only know this because several employees have come to me to tell me what was happening. This employer is beyond words with the things she thinks she can do however, it has had an impact on my treatment. With these recordings in hand, she convinced the insurance company to authorize no further treatment. My attorney has told me I will have my chance to dispute this, but again in the meanwhile I have no treatment for my injuries. I had no idea that one could file a complaint against the insurance company or that my employer is not allowed to deter the insurance company. I will do my research on these subjects and see if I can get some help. Again, thank you so much! I really appreciate your help. Kelly

Dear Nurse in Need: Your employer can not by law deter the insurance company from paying for treatment. The employer may contest your doctor's opinion and require a second opinion and if that opinion is contradictory then you can both request a 3rd independent opinion. If you have any proof that your employer is contesting your treatment, you can file a complaint with the dept. of labor. It is in the employers best interest NOT to deny you treatment as it may put them at risk for a substantial law suit. You may also contact your state's dept. of banking and insurance to file a complaint against the insurer. Blessings, Elaine
